The Fernie Golf Club (the Club) is committed to maintaining the confidentiality of information provided to us by our members, customers and others. We are committed to maintaining the accuracy, confidentiality, and security of your personally identifiable information (“Personal Information”), that personal information gathered will not be sold to third parties, the only gathered information will be pertinent to our operation and that we secure all personal information gathered to the best of our ability.
This document has been prepared to confirm our commitment as well as clearly indicate the type of Personal Information we collect, how we may use that Personal Information, to whom we may disclose it, and how we safeguard that Personal Information and your privacy.
This Privacy Policy has been developed to comply with the Personal Information Protection and Electronic Documents Act (“PIPEDA”).
Information Collection and Use
The Fernie Golf Club collects Personal Information to provide you with the product or service you have requested or to improve upon those services. Personal information may be collected via membership or document submission, through documented conversation or via the Club website. (www.golffernie.com)
Personal Information may only be used or disclosed for the purpose for which it was collected unless you have otherwise consented, or when it is required or permitted by law. Personal Information will only be retained for the period of time required to fulfill the purpose for which we collected it or as may be required by law. All Personal Information will be disposed of when appropriate, and in a manner that is secure, and which respects your privacy.
What is Personal Information
Personal Information’ is information that allows an individual to be identified but does not include:
(a) Member and guest names or information which would enable us to contact members or guests at their place of employment including their name, position name or title, business telephone number, business address, business email and business fax number.(b) personal information about members and guests that is publicly available information such as information available from a public registry or contained in a telephone book.
(c) aggregated information that cannot be associated with a specific individual; and
(d) information that is not about a person but is about a company, association or another organization.
The types of personal information the Club may collect from members and guests include:
(a) Contact information (name, home address, home email address, home phone, and cell phone numbers).
(b) Date of Birth.
(c) Occupation and professional associations if voluntarily provided by the member or guest.
(d) Emergency contact information if voluntarily provided by the member or guest.
(e) Information regarding guests that you bring to the Club.
(f) Personal preferences, including dietary preferences, allergies and other medical conditions if voluntarily provided by the member or guest.
(g) Information on member and guest reservations and Club events that members and guests attend.
(h) Credit card information and/or banking information for billing purposes.
(i) tee time information gathers either online or in person.
(j) Images of members or guests on the Club’s video surveillance system and
(k) Details on when you access the Club, including with which device (or person) you authenticated or identified yourself.
Knowledge and consent are required for the collection, use or disclosure of Personal Information except where required or permitted by law.Consent can be considered as Expressed or Implied.
An example of expressed consent: Your personal information may be needed in order to reserve or book your event, golf tee time or tournament. By agreeing to provide us with your information, Fernie Golf Clubs privacy policy is enacted, and your contact and credit card information is automatically entered into our system.
An example of implied consent: When paying for goods or services in our golf shop or restaurants, the use of your credit card and its information will be considered implied and no further consent will be sought.
Personal Information Disclosure
The Fernie Golf Club will work to ensure your Personal Information is protected. In certain limited circumstances, PIPEDA provides that we may disclose your Personal Information without your consent. Such circumstances include: where required by law or by order of a court or tribunal; where the information is used for the purpose of collecting a debt owed to the Club; where the Personal Information is requested by a government institution to enforce any law; and in the case of an emergency that threatens the life, health or security of an individual. In such circumstances, we will not disclose more information than is reasonably necessary. We will not sell, trade or exchange any Personal Information that we collect.
Communications
We may use your Personal Information to contact you with newsletters, marketing or promotional materials and other information that communicates the service the Club provides.
Safeguarding Customer Information
Personal Information will be protected by security safeguards that are appropriate to the sensitivity level of the information. We take all reasonable precautions to protect your Personal Information from any loss or unauthorized use, access or disclosure. Please be advised that no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.
Accessing Your Personal Information
With limited exceptions as set forth in PIPEDA, you are always entitled to access the Personal Information that we have collected from you. If we cannot provide you with access to your Personal Information, we will advise you within 30 days that we are unable to do so, and will tell you, if possible, why we cannot provide you with such access. If you believe that any factual information contained in your Personal Information is incorrect, please advise us so that we can update our records.
Changes to This Privacy Policy
This Privacy Policy is effective as of June 1, 2020 and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page.
We reserve the right to update or change our Privacy Policy at any time and you should check this Privacy Policy periodically. Your continued use of the Service after we post any modifications to the Privacy Policy on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy.
